Seller Terms

What you're agreeing to when you list.

By checking the attestation box when you publish a listing on The Creative Marketplace (“the Platform”), you are electronically signing this agreement under the federal ESIGN Act and applicable state UETA laws. You confirm each of the following statements is true and accurate as of the moment you submit.

1. Right to list

You represent and warrant that you have the legal right to sell or market the property described in your listing. This means one of the following is true:

  • You are the legal owner of the property.
  • You are an authorized agent under a written, signed listing agreement with the legal owner, and your authorization specifically includes marketing the property on online marketplaces.
  • You qualify under a statutory exemption in the property's jurisdiction that permits you to market this property without a real estate license.

2. Accuracy of listing information

You attest that the information in your listing — including the asking price, financing terms, down payment, monthly payment, interest rate, term length, balloon details, property condition, and title status — is accurate as of today. You will update or remove the listing within 7 days of any material change. Materially inaccurate listings may be suspended or removed.

3. Your sole responsibility for compliance

You are solely responsible for complying with all applicable federal, state, and local laws related to the property and any resulting transaction, including but not limited to:

  • Real estate licensure rules in the property's state
  • Dodd-Frank Act and SAFE Act requirements for residential seller-financed transactions
  • State-specific creative-finance rules (contract-for-deed, lease-option, lease-purchase, wraparound, subject-to)
  • Due-on-sale clause exposure on any underlying mortgage for subject-to or wraparound listings
  • Consumer-protection and truth-in-lending disclosures
  • Federal and state tax reporting obligations
  • Fair housing laws

4. The Platform is a marketplace, not a broker

The Creative Marketplace is an online marketplace. We are not a real estate broker, lender, mortgage loan originator (RMLO), attorney, title company, escrow agent, or financial advisor for you, the buyer, or any other party. We do not verify the accuracy of your listing. We do not endorse, recommend, or vouch for any seller, buyer, listing, or transaction.

We do not negotiate on your behalf. We do not provide legal, tax, financial, or transactional advice. Any verification badges, where shown, reflect limited identity or documentation checks only and do not constitute a representation about the accuracy of financing terms, title status, or legal compliance.

5. Indemnification

You agree to indemnify, defend, and hold harmless The Creative Marketplace, LLC and its officers, members, employees, affiliates, and agents from and against any claims, damages, liabilities, losses, judgments, fines, penalties, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your listing, (b) any inaccuracy or misrepresentation in your listing, (c) any transaction or attempted transaction resulting from your listing, (d) your violation of any law or regulation, (e) your violation of these Seller Terms or the Platform's Terms of Service, or (f) your infringement of any third-party right.

6. Right to remove listings

The Platform may suspend, remove, or refuse to publish any listing at any time, in our sole discretion, with or without notice and without liability to you. Common reasons include materially inaccurate information, suspected fraud, alleged legal violations, abuse of the platform, or upon request from a law enforcement or regulatory authority.

7. No transaction is guaranteed

The Platform does not guarantee that your listing will result in a transaction, that any buyer who inquires is qualified or serious, or that any resulting transaction will close. You assume all risk of dealing directly with buyers and other counterparties.

8. Audit trail

When you check the attestation box and submit a listing, we record the moment of acceptance, the version of these Seller Terms in effect at that time, and your IP address. This record constitutes your electronic signature and may be used as evidence in any dispute or proceeding.

9. Updates to these Seller Terms

We may update these Seller Terms from time to time. The version in effect at the moment you publish a particular listing is the version that governs that listing. The current version is shown at the top of this page.

10. Related agreements

These Seller Terms are in addition to, and do not replace, the Platform's Terms of Service, Privacy Policy, and Disclaimer. In the event of a conflict, these Seller Terms govern matters related to your listings.

11. Governing law

These Seller Terms are governed by the laws of the State of Oklahoma, without regard to its conflict of laws principles. Any dispute arising from these Seller Terms or any listing will be resolved exclusively in Oklahoma County, Oklahoma, subject to the arbitration and class-action waiver provisions in the Platform's Terms of Service.
