Privacy Policy

This Privacy Policy explains how The Creative Marketplace, LLC (“The Creative Marketplace,” “we,” “us”) collects, uses, shares, and protects information about people who use The Creative Marketplace Platform. By using the Platform you agree to this Policy. Capitalized terms not defined here have the meaning given in our Terms of Service.

Information you give us. When you create an account, list a property, submit an inquiry, contact support, or otherwise interact with the Platform, we collect information such as your name, email address, phone number, account credentials, profile information, listing content (including property address, photos, terms, and descriptions), messages you send through the Platform, and any other information you choose to provide.

Property requests.If you tell us what you’re looking for — the area, the monthly payment and down payment that work for you, the financing type, and your situation — we collect that along with your name, email, and phone number, and the consent you gave when you submitted it. We record the exact consent wording, the date and time, and the IP address it came from. You can send a request without an account.

Information collected automatically. We automatically collect technical information such as IP address, browser type, device identifiers, pages viewed, listings viewed, search queries, referring URL, and timestamps. We use cookies and similar technologies to operate the Platform, remember your preferences, secure your account, and measure performance.

Information from third parties. We may receive information from analytics providers, mapping providers, fraud prevention services, and identity verification services we use to operate the Platform.

We do not knowingly collect sensitive categories of personal information beyond what is needed to operate the Platform, and we do not collect personal information from children under 18.

We use information to:

• Operate, maintain, and secure the Platform.
• Create and manage accounts, listings, saved searches, and inquiries.
• Communicate with you about your account, transactions, customer support, and Platform updates.
• Send messages between buyers and sellers, including inquiry emails.
• Where you ask us to, introduce you to a real-estate professional who works creative financing in your market, and verify inquiry phone numbers so the professionals we introduce you to are reaching a real person.
• Improve and personalize the Platform, including measuring engagement and developing new features.
• Detect, investigate, and prevent fraud, abuse, and policy violations.
• Comply with legal obligations and enforce our Terms.

We share information only as described below. We do not share your information with data brokers, advertising networks, or list sellers, and we never make your contact details public.

• With the seller of the property you asked about. When you submit an inquiry on a listing whose inquiries go to its seller, your name, email, phone number, and message are shared with that seller so they can respond to you. When you post a listing, the listing content (including seller name and any contact details you choose to provide) is publicly visible.
• With a real-estate professional, when you ask to be introduced. On listings we handle, the inquiry form carries a disclosure printed directly above its submit button saying that your details go to the listing’s seller or a real-estate professional, and that we may be compensated when a professional receives them. When you submit it on a listing we handle, we share your name, email, phone number, and what you told us you are looking for with one real-estate professional who works creative financing in your market, so they can help you. They may compensate us for that introduction — that is how the Platform stays free for buyers and sellers. Because money can change hands, we treat this as a “sale” or “sharing” of personal information under the California Consumer Privacy Act, and we describe it that way rather than call it something softer. What this is not: we never sell your information to more than one professional, never sell it as part of a list, and never sell it at all unless you submit a form carrying that disclosure. Inquiries on listings that go straight to their seller are never routed to anyone. You can opt out at any time — see Do Not Sell or Share My Personal Information. We do not sell or share the personal information of anyone we know to be under 18.
• With a real-estate professional, when you send us a property request. When you tell us what you’re looking for, we may share your name, email, phone number, and the criteria you gave us with a real-estate professional who works creative financing in your market, so they can bring you matching properties. They may compensate us for that introduction, which we treat as a “sale” or “sharing” of personal information under the California Consumer Privacy Act — the same as the introductions described above, and we describe it the same way. We never sell your request as part of a list and never sell it for advertising. You can opt out at any time using Do Not Sell or Share My Personal Information, and you can ask us to delete your request entirely.
• Service providers. We share information with vendors that operate parts of our service (hosting and database via Supabase; transactional email via Resend; mapping; analytics; payments where applicable). They are bound by confidentiality and data protection terms.
• Legal compliance and safety. We may disclose information when required by law, subpoena, or court order, or where we believe disclosure is necessary to protect rights, safety, or property.
• Corporate transactions. If we are involved in a merger, acquisition, financing, or sale of assets, information may be transferred as part of that transaction.
• With your consent. We share information for any other purpose with your consent.

We use cookies and similar technologies for authentication, session management, preference storage, security, and analytics. You can control cookies through your browser settings; disabling cookies may impair Platform functionality.

We retain information for as long as your account is active or as needed to provide the Platform, comply with legal obligations, resolve disputes, and enforce agreements. You may request deletion as described below.

Electronic-signature records. When you accept our Terms of Service at sign-up or the Seller Terms when publishing a listing, we record your user ID, the document version in effect at that moment, your IP address, and the timestamp of acceptance. These records constitute your electronic signature under the federal ESIGN Act and applicable state UETA laws and are retained for the applicable statute of limitations to support dispute resolution and audit.

We use commercially reasonable administrative, technical, and physical safeguards to protect information, including encrypted transport (TLS), encrypted-at-rest storage, access controls, and row-level security on user data. No system is perfectly secure; we cannot guarantee absolute security.

Depending on where you live, you may have the right to access, correct, delete, or port your personal information, to restrict or object to certain processing, and to withdraw consent. To exercise these rights, email support@thecreativemarketplace.com. We will verify your identity before responding.

California residents: The CCPA/CPRA grants you the right to know what we collect, to delete it, to correct it, to opt out of the sale or sharing of personal information, and not to be discriminated against for exercising any of those rights.

As described in Section 4, when you ask us to introduce you to a real-estate professional — either from a listing inquiry or by sending us a property request — that introduction is a sale or sharing of personal information under the CCPA, because the professional pays us a fee for it. The categories involved are identifiers (name, email, phone) and your stated property preferences; they go to real-estate professionals; and the purpose is to connect you with someone who can help you buy the property you asked about. We do not sell or share personal information for advertising, and we do not sell or share the personal information of anyone we know to be under 18.

To opt out, use Do Not Sell or Share My Personal Information — no account required. Opting out never affects your ability to use the Platform, search listings, or contact sellers. For any other right, email the address above; we will verify your identity before responding, and you may use an authorised agent.

EEA / UK residents: Where we process personal data under GDPR/UK GDPR, our lawful bases are: performance of a contract, legitimate interests (such as operating and improving the Platform), consent (where required), and compliance with legal obligations. You may lodge a complaint with your local supervisory authority.

The Platform is operated from the United States. If you access the Platform from outside the United States, your information will be transferred to, stored in, and processed in the United States.

The Platform is not directed to children under 18 and we do not knowingly collect personal information from anyone under 18. If you believe a child has provided us information, contact us so we can delete it.

We may update this Privacy Policy from time to time. We will update the “Effective” date and, for material changes, provide reasonable notice (such as by email or in-app notice).
