Privacy Policy

This Privacy Policy explains how The Creative Marketplace, LLC (“The Creative Marketplace,” “we,” “us”) collects, uses, shares, and protects information about people who use The Creative Marketplace Platform. By using the Platform you agree to this Policy. Capitalized terms not defined here have the meaning given in our Terms of Service.

Information you give us. When you create an account, list a property, submit an inquiry, contact support, or otherwise interact with the Platform, we collect information such as your name, email address, phone number, account credentials, profile information, listing content (including property address, photos, terms, and descriptions), messages you send through the Platform, and any other information you choose to provide.

Property requests.If you tell us what you’re looking for — the area, the monthly payment and down payment that work for you, the financing type, and your situation — we collect that along with your name, email, and phone number, and the consent you gave when you submitted it. We record the exact consent wording, the date and time, and the IP address it came from. You can send a request without an account.

Information collected automatically.We automatically collect technical information such as IP address, the approximate location your IP address indicates (city and state — never a precise location), browser type, device identifiers, pages viewed, listings viewed, search queries, referring URL, and timestamps. We use cookies and similar technologies to operate the Platform, remember your preferences, secure your account, and measure performance.

Information from third parties. We may receive information from analytics providers, mapping providers, fraud prevention services, and identity verification services we use to operate the Platform.

We do not knowingly collect sensitive categories of personal information beyond what is needed to operate the Platform, and we do not collect personal information from children under 18.

We use information to:

• Operate, maintain, and secure the Platform.
• Create and manage accounts, listings, saved searches, and inquiries.
• Communicate with you about your account, transactions, customer support, and Platform updates.
• Send messages between buyers and sellers, including inquiry emails.
• Verify inquiry phone numbers, so a seller who calls you back is reaching a real person.
• Understand, in aggregate, where interest in the Platform and in the properties on it comes from.
• Improve and personalize the Platform, including measuring engagement and developing new features.
• Detect, investigate, and prevent fraud, abuse, and policy violations.
• Comply with legal obligations and enforce our Terms.

We share information only as described below. We do not share your information with data brokers or advertising networks, and we never publish a buyer's contact details. A seller chooses what appears on their own listing — anything they put there is public by design, and that is the only contact information we show publicly.

• With the person who posted the listing you asked about. When you submit an inquiry, your name, email, phone number, and message are shared with the person who posted that listing — the seller or authorized representative, such as a listing agent — so they can respond to you. When you post a listing, the listing content (including seller name and any contact details you choose to provide) is publicly visible.
• With a lender or capital partner, when you ask us to. If you send a capital request, we share your name, email, phone number, and the request itself with the lender or capital partner you choose or that we match you with, so they can respond to you.
• With other sellers, professionals, and partners. We may share or sell your inquiry or your property request — your name, email, phone number, and what you told us you are looking for — with other sellers, real estate professionals, lenders, and partners, so they can contact you about properties and financing. By partners we mean businesses that sell, finance, or close on property: sellers, licensed real estate agents and brokers, lenders and mortgage professionals, title and escrow companies, and insurers. We do not share your information with advertising networks, and we do not share it with data brokers or list resellers — anyone who receives it must be a business that can act on your request, not one that resells it. You can stop this at any time on our Do Not Sell or Share page, free, without affecting your use of the site.
• What you sent us before September 24, 2026. Inquiries and property requests you sent before that date are not shared or sold this way. They were collected under an earlier version of this policy that said we would not do it, and we will ask for your consent before anything changes for them.
• Service providers. We share information with vendors that operate parts of our service (website hosting via Vercel; database via Supabase; transactional email via Resend; error monitoring via Sentry; analytics via PostHog; phone-number verification via Twilio; mapping and address lookup; AI help drafting listing descriptions; encrypted backups; payments where applicable). They are bound by confidentiality and data protection terms.
• Legal compliance and safety. We may disclose information when required by law, subpoena, or court order, or where we believe disclosure is necessary to protect rights, safety, or property.
• Corporate transactions. If we are involved in a merger, acquisition, financing, or sale of assets, information may be transferred as part of that transaction.
• With your consent. We share information for any other purpose with your consent.

We use cookies and similar technologies for authentication, session management, preference storage, security, and analytics. Essential cookies keep you signed in and the site working. Beyond those, we use PostHog to understand how the site is used, a cookie that remembers how you first found us (kept up to two years), and our own page-view counts, which show sellers how often their listings are viewed. PostHog also records how visitors use the site (clicks, scrolls, and the pages they view) so we can find and fix problems. What you type is hidden from these recordings, and we don’t record sign-in pages, private messages, or the seller inbox. We use Sentry to catch errors; it does not record your session.

You can turn off analytics, including these recordings, at any time with the button below (the “Cookie choices” link in our footer brings you here), and we treat a Global Privacy Control signal from your browser as the same choice. Essential cookies stay on. You can also control cookies through your browser settings; disabling them may impair Platform functionality.

We retain information for as long as your account is active or as needed to provide the Platform, comply with legal obligations, resolve disputes, and enforce agreements. You may request deletion as described below.

Electronic-signature records. When you accept our Terms of Service at sign-up or the Seller Terms when publishing a listing, we record your user ID, the document version in effect at that moment, your IP address, and the timestamp of acceptance. These records constitute your electronic signature under the federal ESIGN Act and applicable state UETA laws and are retained for the applicable statute of limitations to support dispute resolution and audit.

We use commercially reasonable administrative, technical, and physical safeguards to protect information, including encrypted transport (TLS), encrypted-at-rest storage, access controls, and row-level security on user data. No system is perfectly secure; we cannot guarantee absolute security.

Depending on where you live, you may have the right to access, correct, delete, or port your personal information, to restrict or object to certain processing, and to withdraw consent. To exercise these rights, email support@thecreativemarketplace.com. We will verify your identity before responding.

California residents: The CCPA/CPRA grants you the right to know what we collect, to delete it, to correct it, to opt out of the sale or sharing of personal information, and not to be discriminated against for exercising any of those rights.

We may sell or share the contact details and property criteria you give us with other sellers, real estate professionals, lenders, and partners, as described in section 4. We do not share personal information for cross-context behavioral advertising, and we do not sell or share the personal information of anyone we know to be under 18. A capital request goes only to the lender or capital partner you ask us to contact.

You can stop it at Do Not Sell or Share My Personal Information — no account required. Your opt-out stays on file permanently and we check it before we share or sell your information with anyone other than the seller of a listing you contacted. It does not stop an inquiry you send from reaching that seller; that is the message you chose to send. Opting out is free and never affects your ability to use the Platform, search listings, or contact sellers. For any other right, email the address above; we will verify your identity before responding, and you may use an authorised agent.

EEA / UK residents: Where we process personal data under GDPR/UK GDPR, our lawful bases are: performance of a contract, legitimate interests (such as operating and improving the Platform), consent (where required), and compliance with legal obligations. You may lodge a complaint with your local supervisory authority.

The Platform is operated from the United States. If you access the Platform from outside the United States, your information will be transferred to, stored in, and processed in the United States.

The Platform is not directed to children under 18 and we do not knowingly collect personal information from anyone under 18. If you believe a child has provided us information, contact us so we can delete it.

We may update this Privacy Policy from time to time. We will update the “Effective” date and, for material changes, provide reasonable notice (such as by email or in-app notice).
